General Terms of Use for the KAJOOM’s Services

Welcome to Kajoom.Ca!

Thank you for choosing our products and services (the “Services”). The Services are provided by the Kajoom.Ca website (hereinafter ‘kajoom.ca’), which you can contact by writing to:

Marc-Antoine Minville – Kajoom.Ca
120 rue Dequoy, CP 1051, Saint-Gabriel-de-Brandon, Qc. (Canada) J0K 2N0.

The use of our Services implies your acceptance of these Terms of Use. We invite you to read them carefully.

Our Services are very diverse, so additional or special terms may be added to certain Services (for example, web hosting services). These additional conditions will be made available to you with the Services concerned. If you choose to use these Services, you agree that these additional conditions are also part of your contractual engagement with us.

Use of our Services

You must comply with the rules applicable to the Services you use.

Do not use our Services improperly. For example, do not attempt to interfere with or access our Services using any method other than the interface and instructions that we make available to you. You must only use our Services in compliance with the laws in force. We may suspend or terminate the provision of our Services if you fail to comply with any applicable terms or regulations, or if we have a suspicion of improper use.

The use of our Services does not give you any intellectual property rights over our Services or the content you access. You may not use any content obtained through our Services without the permission of the owner of such content, unless permitted by law. These Terms of Use do not give you the right to use any brand or logo in our Services. You may not delete, obscure or modify the legal notices displayed in or with our Services.

Our Services display content that does not belong to Kajoom.Ca. These contents are the sole responsibility of the entity that made them available. We may need to check the contents to make sure they comply with the law or our conditions of use. We reserve the right to remove or refuse to post any content that we reasonably believe to be in violation of the law or our policies. The fact that we reserve this right does not necessarily mean that we check the content. Therefore, please do not assume that we are checking the contents.

As part of your use of the Services and the performance of our contractual engagement, we may send you messages related to the operation or administration of the Services and other information. You can choose to stop receiving some of these messages.

Your KAJOOM account

You may need an account to use some of our Services. Your account can be created by you or assigned to you by an administrator (for example, your employer or your educational institution). If your account has been assigned to you by an administrator, there may be different or additional terms of service and your administrator may access or disable your account.

If you learn that your password or account has been misused, please take the appropriate security measures.

Protection of privacy and copyrights

The Kajoom.Ca Privacy Policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Kajoom.Ca may use this data in accordance with this Privacy Policy.

We strongly encourage the respect of copyright on content posted on the web via our services. If you believe that a user is infringing on your copyright and would like to notify us, please follow the instructions available in our Contact Center for Disclosure. You will also find information on Kajoom.Ca’s rules for responding to such notifications.

Your content and services

Some of our services allow you to submit content. You keep all your intellectual property rights on these contents. What’s yours?

Kajoom.Ca (and anyone working with Kajoom.Ca) has worldwide license to use, storage, reproduction, modification, creation of derivative works (translations, adaptations or other modifications intended to improve the functioning of your content through our services), communication, publication, public representation, display or public distribution of said content. Your rights under this license are limited to the operation, promotion or enhancement of our Services, or the development of new Services. This authorization remains for the whole of the protection of your business, even if you stop using our Services (for example, for a business listing that you have added to Kajoom.Ca). Some Services offer you the possibility to access and delete this service. Some Services also provide conditions or settings restricting the scope of our services to you. Make sure you submit to our services.

You will find additional information on how to use Kajoom. When you submit feedback or suggestions about our services, we are entitled to your permission.
About software used by our services

If a Service requires or includes the use of downloadable software, updates to this software (new versions or features) may be performed automatically on your device. Some Services allow you to change your automatic update settings.

Kajoom.Ca grants you, for free, a personal, non-transferable, non-exclusive, worldwide license to use the software provided to you by Kajoom.Ca as part of the Services. This license is exclusively intended to enable you to use and benefit from the Services provided by Kajoom.Ca, in compliance with these Terms of Use. You may not copy, modify, distribute, sell or rent part or all of our Services or the software that forms part of them. Similarly, you may not decompile or attempt to extract the source code of such software, except in cases where the right of decompilation is authorized by law and within the limits of the law, or which you have obtained our prior written permission.

The use of open source software is important to us. Some of the software used by our Services may be offered under an open source license that we will make available to you. The Open Source License may contain provisions that have specific priority over some of these conditions.

Modification and termination of our Services

Kajoom.Ca is constantly changing and improving its Services. We may add or remove features or functions, and we may also suspend or terminate a Service.

You may stop using our Services at any time. We hope, however, that you will continue to use them. Kajoom.Ca is entitled to stop providing you with all or part of the Services, or to add or create new limits to the use of the Services at any time.

For us, you remain the owner of the data you entrust to us and we think it is important that you access it. If we are to discontinue a Service, we will notify you in a reasonable time and give you the opportunity to retrieve information from this Service.

Warranties and Disclaimers

Our offer of Services is subject to an obligation of means, within the limits of what is commercially reasonable. We hope you find pleasure in using them. Our Services are, however, subject to a limitation of warranty.

Except as expressly provided in these Terms of Use or additional terms of use, neither Kajoom.Ca, nor its suppliers or distributors, make any specific promises regarding the Services. For example, we make no commitment regarding the content of the Services, the specific features available through the Services, their reliability, availability or suitability to your needs. We provide our Services “as is”.

Some jurisdictions do not allow the exclusion of certain warranties, such as the implied warranties of merchantability, fitness for a particular purpose, and compliance. To the extent permitted by law, we exclude all warranties.

Responsibility for our Services

To the extent permitted by law, Kajoom.Ca, its suppliers and distributors, disclaim all liability for loss of profits, income or data, or indirect, special, consequential, exemplary or punitive damages.

To the fullest extent permitted by law, Kajoom.Ca’s, its suppliers ‘and distributors’ total liability for any claim under these Terms of Use, including any implied warranties, is limited to the amount that you have paid to use the Services (or, if we choose, to provide you with these Services again).

In no event shall Kajoom.Ca, its suppliers or distributors, be liable for any loss or damage that would not have been reasonably foreseeable.

We recognize that in some countries you may enjoy certain rights as a consumer. If you use the Services for personal use, nothing in these Terms of Use or any additional terms of use limits the legal rights of the consumer to whom no contract may derogate.

Use of our Services by a company

If you use our Services on behalf of a company, the company must accept these Terms of Use. In addition, Kajoom.Ca, its affiliates, agents and employees shall be released from all liability and shall be indemnified against any claim, suit or legal action arising out of or in connection with its use of the Services or following any breach of this Agreement. Conditions of Use, including any liability and financial burden resulting from claims, losses or damages, prosecution and judgments, and related legal and legal fees.

About these Terms of Use

We may change these Terms of Use or any additional terms of use that apply to a Service, for example, to reflect changes in the law or our Services. We recommend that you periodically review the Terms of Use. Changes to these Terms of Use will be posted on this page. We will post a notice of modification of the additional terms of use in the relevant Service. The amendments will not apply retroactively and will come into effect at least fourteen (14) days after their publication. However, changes specific to a new feature of a Service or changes made for legal reasons will apply immediately. If you do not agree to any changes to the Terms of Use for a given Service, you must stop using this Service.

In the event of a conflict between these Terms of Use and additional terms of use, the latter shall prevail.

These Terms of Use govern your relationship with Kajoom.Ca. They do not create rights for third-party beneficiaries.

If you do not comply with these Terms of Use and we do not take immediate action in this regard, it does not mean that we waive our rights (for example, to take action later).

If it turns out that a particular condition is not applicable, this will not affect the other terms of these Terms of Use.
